3.       Shipment and Delivery
3.1          Cost of shipment and packing
Shipments will be done through General Logistic Systems Germany or Deutsche Post World Net DHL Express, typically. Within Germany, shipment is free if the order volume is 300 € (incl. taxes) or higher. Otherwise, shipment charges are as follows:

3.2          Shipment charges for returns
Not prepaid return shipments are not accepted. Customers within the European Union will receive credit for return shipment cost (for order volume greater than 40 €). Please choose the most cost-effective method of transportation. Customers outside of the European Union need to carry the cost for return shipment. Please make sure your return shipment is insured againt loss and damage during transportation.

3.3          Payment

We accept Eurocard/Mastercard, VISA, American Express and JCB credit cards. On currencies we accept Euro, US Dollar and Yen. Your credit card will be charged at the time of shipment.

Bank Debit (only available in Germany)
We will debit your bank account (order amount plus shipment and packing cost) at the time of shipment.

Collect on Delivery (COD, only within Germany)
The amount to be collected includes the Deutsche Post collect on delivery fee (6 € as of June 2004) in addition to the order amount plus shipment and packing cost.

3.4          Delivery Time
Typically, delivery time will be about 3 to 4 weeks, as many products are manufactured according to your specifications. For embroidered leather pants, delivery time will be about 5 to 6 weeks, normally. Our delivery dates are estimates and subject to change unless explicitely noted.

3.5          Partial Shipments
We aim to ship all items in one shipment. If we decide to do partial shipments, shipment cost will only be charged for a single shipment.

4.       Close of Contract
The customer agrees to verify the items to be ordered (including products, quantities, special requests etc.) for correctness before placing the order.

Our product offering, as presented in the internet or other media, is without engagement. With order placement, the customer agrees to purchase the items ordered. With acceptance of the purchase order, we will send an order acknowledgement which validates the purchase contract.

We will inform the customer in case some or all of the items ordered are not available. The customer will receive credit for any excess payments done.

5.       Transfer of Ownership
The products shipped remain in the ownership of Astrid Bauchmüller Spezialversand für Lederhosen e.K., Inhaber Peter Bauchmüller until complete payment.

7.       Products Manufactured to the Customer’s Specifications
Custom-made products: Custom-made products are those products which where newly produced on your explicit order. It is also a custom-made product if your order is for products in regular sizes.

Products manufactured to your size: Such products are not available as a standard size in our catalogue and are manufactured to the customer’s specifications.

Specifications: It is the customer’s responsibility to ensure that any sizes specified in the order are correct and up-to-date. Our sales catalogue includes instructions how to correctly measure your size. For products manufactured to your specifications, any charges incurred through changes or rework are covered by the customer if such charges are a result of wrong specifications.

Cash In Advance: For products manufactured to your specifications, we reserve the right to invoice 50% of the amount in advance. For special requests, the products are manufactured as soon as the advance payment is received.

Return Policy: Newly manufactured goods are excluded from our return policy but we are fair to you if we have the chance to sell the product again. For this reason please ask for returning the product and money.

8.       Origin and Quality
All offered articles are “made in Germany”. Also, the leather processed comes exclusively from leading German or Austrian tanneries. The tanning with chromium is done only with non-toxic, trivalent chromium compounds. The strict German regulations for ecologically harmful fabrics or fabrics which may pose a risk to health, especially Pentachlorphenol (PCP), are respected strictly during the procession.The limit for the dioxin including PCP set by the European Commission for leather clothes from Turkey and Pakistan lies 200 times (!) higher. The most, seeming worth the price alleged „traditional Bavarian lederhosen” (Also special for children!!) are manufactured in these countries.

We also guarantee that all of our trousers are free of toxic AZO dyes.

9.       Defects
The customer will notify the seller in writing of any obvious defects, including transportation damages within two weeks of shipment. Notifications can be done through mail, email or fax. The customer needs to meet the deadline; otherwise there is no guarantee that obvious defects will be fixed.

Defects which are not obvious are excluded from the above deadline.

At leather - as a natural product - not avoidable deviations of the product features (e.g. color) don't represent any lacks and can't be queried.

10.  Data Protection
We store and use personal data only to process your order. We do not transfer personal data to third parties withour your consent unless it is allowed by law and supports the fullfillment of the contract or our justified interests. Our data protection policy is compatible with the German Bundesdatenschutzgesetz (BDSG), as well as the Teledienstedatenschutzgesetz (TDDSG).

In order to process your order, we require your name, size, login data, address for invoice and shipment, phone number and email address. We also store the internet (IP) address used during order placement.

For credit card purchases, we require the type of credit card (VISA, Master/Eurocard, AMEX or JCB), credit card number, expiration date, as well as the ID number on the back of the card.

For payment by debit note, we need the name of the account owner, the account number, as well as the bank ID. For other types of payment, we need no further information.

Data transferred to our site is secured through SSL (Secure Socket Layer). The key length is RSA 1024 bit / Triple-DES 168/112 bit. SSL is a security technology which allows data, for example credit card information, to be safely transferred through the internet. Data is encrypted so that it can only be decrypted by the payment system. Unauthorized persons can decrypt the data only with substancial effort. Most internet browsers support this security technology.

11.  Burden of Proof
Data stored electronically by the seller is considered acceptable proof of data transmissions, contracts and payments between both sides.

Should the customer have evidence of unauthorized use of his/her identity, he/she is liable for prompt notification to the seller, which shall include all available evidence of misuse.

Should the customer neglect these duties, or should there be sufficient evidence of action by the customer, he/she carries the burden of proof of unauthorized use of the customer’s identity.

12.  Exclusion of Liability for External Internet Links
Our web site may include links to other (external to the seller’s) internet sites. The contents and appearance of such sites are beyond the seller’s control. We are not liable for linked sites.

13.  Applicable Laws
The contract between the customer and the seller is based on German laws and regulations. The UN terms of sale are not applicable. Should German laws refer to foreign regulations, such regulations are not applicable to the contract between the customer and the seller.

Should individual conditions of the contract turn out to be void, or should, during fulfillment of the contract, missing regulations become apparent, the remaining regulations, as well as the overall contract, remain valid.
