1.       Scope of Validity

The following terms and conditions exclusively apply to all business relations with Astrid Bauchmüller Spezialversand für Lederhosen e.K., subsequently referred to as seller, including product sales and other services. No other terms and conditions apply, even if such other conditions are not explicitly declined by the seller

Our product offering is without engagement until further notice. Product descriptions were done to the best of our knowledge. Colours may vary, depending on the type of leather (natural product). For more information, please visit our internet site. 
 
We reserve the right to revise our products. Therefore, item descriptions are subject to change without notice. Prices are subject to change without notice.
All quoted prices are for information purposes and are initially recorded for deliveries within the EU including VAT.

3.       Shipment and Delivery

3.1          Cost of shipment and packing

 
Our Goods are supplied normally by DHL 
Within Germany the delivery is free of charge from a gross order value of € 300 (including VAT) . If your order will not achieve the aforementioned gross order value or you  receive your package to a destination outside Germany, we will charge you in addition to the purchase price following::

3.2          Shipping cost for returned goods (point 6) or defect claims (point 9)

 
Not prepaid returns will not be accepted! Customers within the EU –if the order is more than  € 40, - , get a refund for the postage and the value of the order. Customers outside the EU, the return transport costs are unfortunately not be refunded. Please choose your own interests in the cheapest shipping route for insured parcels. 3.4          Delivery time

 
Normal delivery time is approximately 1 to 3 weeks, because the product is often made specifically to your needs. For embroidered leather products  the delivery time, depending on the model, varies between 1 to 6 weeks. Delivery dates quoted by us are not binding, unless we have agreed with you a delivery date expressly in writing.

3.5          Partial deliveries

Partial deliveries are subject to us, we should endeavor to avoid part-deliveries. In the case of partial deliveries will be of course the shipping cost is calculated only once.

4.       Contract negotiations and conclusion

You agree to check your ordered articles and information, along with special needs, for accuracy before submitting the order.

6. Return Policy

 
Described below are excluded from the statutory right of return are goods that are produced at your request, explicitly. Return Policy:
You can cancel your contract within 14 days without giving any reasons in text form (e.g. letter, fax, e-mail) or - if the goods arrived before the deadline - by returning the goods. The time limit begins after receipt of this notice in written form, but not before receipt of the goods to the consignee (in case of recurring deliveries of similar goods not before receipt of the first partial delivery) and also does not fulfill our obligations under Article 246 § 2 in connection with § 1 Abs. 1. and 2 EGBGB as well as our duties according to § 312g Satz 1 BGB in conjunction with Article 246 § 3 BGB. Return:
In the case of an effective cancellation the mutually received performances are to be returned and possibly derived benefits (e.g. usage advantages). In case of deterioration of the goods, compensation may be claimed. This does not apply if the deterioration of the goods which is due to their inspection - as they would in a retail store. In addition, you can avoid paying compensation by not using the goods like an owner and omitting everything, which impairs their value. Transportable goods are returned at our risk. You have to pay the regular cost of the return if the delivered goods correspond to the ones ordered and if the price of the goods returned is not exceeding 40 Euros, or if you are at a higher price of goods are still not at the time of full payment or a contractually agreed part payment provided. Otherwise, the return is free of charge. Not shippable goods are picked up. Obligations to reimburse payments must be made within 30 days. The time limit begins for you when you send your cancellation or the goods to us with their receipt.
 
Exclusion of right to return: 
The right of return pursuant to § 312 paragraph 4 No. 1 BGB does not apply to distance contracts for the supply of goods that are produced according to customer specifications or clearly tailored to personal needs. Custom sizes are according to that extent. Section 7 except the right of return.

7.     Customization

Customization= the products are custom-made to your individual measurements and are outside the standard sizes offered by catalog.
You are responsible for ensuring that you have the dimensions specified in your order thoroughly checked for completeness and correctness. Our sales material will give you appropriate instructions to help you to take reliable measurements. We point out that mistakes which are based on erroneous information are at your responsibility and expense.
A Exclusion of right to return 
Custom-made products are not suitable for resale. As a result, the application of the right to return under § 312, paragraph 4 No. 1 BGB is excluded.
 

8.       Origin and quality of our products

 
All our leather garments are "MADE IN GERMANY". The processed leather for our products comes exclusively from leading tanneries / dyeing. Also, the chrome tanning takes place only with non-toxic trivalent chromium compounds. The strict German regulations for environmentally harmful or hazardous substances, including pentachlorophenol (PCP) are strictly adhered to during the processing of rawhide. By the European Commission for Pakistani and Turkish leather garments allowed limit for dioxins PCP is 200 times (!) Higher. Also, all our leather garments are free from the toxic azo dyes.
 

9.       Claims

Obvious defects in the delivered goods, including transport damages have to be indicated in writing at least two weeks after delivery with a precise description. For the deadline it is sufficient if the notice is mailed within the period of two weeks to in paragraph 6 above mentioned address (date of postmark). Instead of the written notice you can also send us an e-mail or fax. When the notification deadline is missed the defect claims fall for obvious defects. Claims for non-obvious defects remain unaffected.
As leather is a natural product minor changes as differences in product characteristics (eg color) are not defects and can not be objected to.

10.       Privacy

We collect, process and use your personal information solely for the speedy processing of orders and to provide you with convenient shopping. Your personal information will not be given without your consent to third parties, except as permitted by law and serves the purpose of the contractual relationship or protect our legitimate interests. Our Privacy Policy complies with the Federal Data Protection (BDSG) and the Teleservices Data Protection (TDDSG).
What information do we need and how we use it?
 
To edit your order, we require your first name, last name, clothing size, or other appropriate dimensions, your login information (user ID and password), your billing address (reported place of residence) - and - if different - your delivery address (street, zip code, city) , your phone number or e-mail address. The telephone number or e-mail address we need to quickly contact for any questions regarding your order. During the ordering process you are using the Internet address (IP address) is automatically saved.
Other required information:
For credit card payment we need the credit card type (Visa, MasterCard / Euro Card, American Express or JCB credit card), your credit card number, expiration date (month / year) of credit card and the check number on the back of the card.
